Terms of Service

1. Acceptance of Terms

By accessing or using SEDDT's monitoring platform, services, hardware, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legal agreement between you and [SEDDT LEGAL ENTITY NAME] ("SEDDT", "we", "us", or "our").

If you are accepting these Terms on behalf of a company or organization, you represent that you have authority to bind that entity, and "you" refers to both you individually and the entity.

2. Description of the Service

SEDDT provides a Smart Environmental Monitoring platform that enables organizations to monitor sensor and gateway data — including but not limited to temperature, pressure, and environmental conditions — through a web-based portal and connected hardware devices. Features may include device management, real-time alerts, reporting, and user administration.

We may modify, suspend, or discontinue features at any time without prior notice. We will use reasonable efforts to notify customers of material changes that affect paid services.

3. Accounts and Eligibility

Account creation

To use the Service, you must create an account or be invited as a user by an administrator of an existing customer account. You agree to provide accurate information and to keep your credentials confidential.

Eligibility

You must be at least 18 years of age and capable of entering into a binding contract to use the Service. The Service is not directed at children under 13, and we do not knowingly collect data from minors.

Account security

You are responsible for all activity that occurs under your account. Notify us immediately at support@seddt.com if you suspect unauthorized access.

Hardware devices (sensors, gateways, transmitters, etc.) supplied or recommended by SEDDT remain subject to their respective manufacturer warranties. SEDDT is not responsible for damage to hardware caused by improper installation, environmental conditions outside specified operating ranges, electrical surges, or use contrary to documentation.

You are responsible for ensuring that hardware is installed and maintained in compliance with applicable local codes and regulations.

6. Customer Data and Ownership

You retain all rights to data you upload, generate, or transmit through the Service ("Customer Data"). You grant SEDDT a limited, non-exclusive, worldwide license to process Customer Data solely for the purpose of providing and improving the Service.

SEDDT will not sell Customer Data to third parties. Our handling of personal information is further described in our Privacy Policy.

7. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by SEDDT or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited rights granted in these Terms, no rights are transferred to you.

Feedback you provide to SEDDT may be used by us without obligation or compensation to you.

8. Fees and Payment Where applicable

Certain features or service tiers may require payment of fees. Pricing, billing cycles, and payment terms will be specified at the point of purchase or in a separate written agreement. Fees are non-refundable except as required by law or as expressly stated in your service agreement.

Failure to pay may result in suspension or termination of the Service.

9. Disclaimers and Limitations Important

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise. SEDDT specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

SEDDT does not warrant that the Service will be uninterrupted, error-free, or that monitoring alerts will always be delivered on time or at all. The Service is not a substitute for primary safety systems, regulated alarm systems, life-safety equipment, or compliance with applicable codes and regulations. You are responsible for maintaining appropriate backup systems and processes.

To the maximum extent permitted by law, SEDDT's total cumulative liability for any claims arising from or related to the Service shall not exceed the fees paid by you to SEDDT in the twelve (12) months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

SEDDT shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business opportunity.

10. Indemnification

You agree to indemnify and hold SEDDT, its officers, employees, and affiliates harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any third-party right.

11. Termination

You may stop using the Service at any time. SEDDT may suspend or terminate your access immediately if you violate these Terms, fail to pay fees, or engage in conduct that we determine, in our reasonable judgment, presents legal or operational risk to SEDDT or other users.

12. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective" date at the top and, where appropriate, notify you by email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
